Dear Members and Readers

As 2021 draws to a close, the Omicron COVID variant has heightened concerns around the impact on businesses, lives, livelihoods and the economy. Members are again urged to take every precaution to combat the spread of the virus and protect the workplace. Please contact the Association for advice on COVID protocols and other related matters. 

The FNB/BER Building Confidence Index declined by 1 point to 34 in Quarter 4 of 2021. It was however noted that there was an increase in main contractor building activity, boosting profitability. There was also significant improvement reported in activity at the start of the building pipeline, which augurs well for the industry as it signals more work on the horizon. 

As we move towards a new year, we would like to assure members that the Association will continue to be unrelenting in its efforts to represent your best interests at all levels as we continue to lobby and advocate for a more sustainable construction industry. There are several initiatives underway which are designed to bring some reprieve for our members amidst the recent challenges. Members are reminded that the Print Studio offers a courier service and will be stockists of the GCC suite of contracts.  

In this final edition for 2021, we highlight why you should never perform work without a written contract.  Cox Yeats have also provided a follow up to their previous article “Enforceability of Adjudicators Decisions” which delves further into the subject. As construction sites close for the December period, we provide some recommended safety protocols for implementation to safeguard your site. The Association proudly invites members to make application for their employees to participate in a skills intervention for site supervisors and foreman.

The importance of a signed agreement

Master Builders KwaZulu-Natal continually elaborates how critically important it is for contractors to have a signed agreement in place, before commencing work on a building or construction project.  As part of the Association’s ongoing effort to ensure that members are contractually astute, Master Builders KwaZulu-Natal recently hosted two Contractual and Legal workshops which focused on the JBCC suite of contracts. The first was tailored specifically for sub-contractors while the other, was aimed exclusively at main contractors.

The conversation around the shortage of trade skills has been taking place for many years. Various research projects have concurred with these sentiments. The quandary with which we are faced is that the route to a full qualification is often too long. In many cases these skills are required with urgency. To meet its immediate skills, the industry requires the implementation of quick impact short skill interventions.

Sequel to Enforceability of Adjudicator's Decisions

Dear Members and Readers

Master Builders KwaZulu-Natal prides itself on addressing skills development in the construction sector. The Bursary Programme has been offered since 2015 to those pursuing studies in Built Environment disciplines. Bursary applications for the 2022 academic year are now open. Interested parties may contact the Association prior to the closing date of 7 January 2022.

The Vuka Makhi Programme has been revised to comprise of three different components in order to support our members with enhancing workplace skills. The Candidacy and professional registration component aims to support graduates on their route to professional registration. Short Skills interventions will be addressed and the recognition of employee skills through formal assessment will be undertaken through the Skills Card component. Members are invited to take advantage of this great opportunity.

The Association is continuously surveying risk exposures in the industry in order that these can be mitigated in the course of our lobbying and advocacy function. The management of ergonomic risks has led to an increased bouquet of membership services. In addition, the OHS Consulting unit has been expanded to include consultation on paid ergonomics services.

The Association is pleased to announce the launch of its Business Support Consultancy, which is designed to primarily focus on matters related to B-BBEE, workplace skills plan and employment equity. The full details of the Consultancy are included in this edition of the newsletter and members are urged to contact the Association for a quote to assist you with your employment equity online reporting and other requirements.

Members are reminded that the Association will be hosting free Contractual and Legal workshops on the JBCC suite of contracts for members. The workshops are tailored specifically for main contractors or sub-contractors.

Master Builders KwaZulu-Natal proudly announces the launch of the revised Vuka Makhi Programme

The Master Builders KwaZulu-Natal Vuka Makhi Programme has been offered since 2015 and was initially focused on grooming learners from education to employment in the construction sector and has produced 100 post-matric learners. Twenty learners are currently writing their final 2021 matric examination and this will increase the figure to 120. The Association has since revised the Programme with a more targeted approach on enhancing construction skills.

The management of ergonomics in the South African construction industry is legislated through the Occupational Health and Safety Act 85 of 1993 and its regulations; namely the Construction Regulations of 2014 and the Ergonomics Regulations of 2019. Despite these legislative imperatives, the implementation of ergonomics in the South African construction industry is limited.

Section 32 of the Constitution states that “Everyone has a right of access to any information held by the state and any information held by another person that is required for the exercise or protection of any rights.” The Promotion of Access to Information Act, No. 2 of 2000 (PAIA) was enacted to give effect to the constitutional right of access to information and governs how one would access such information.

When is an adjudicator's decision unenforceable?

Adjudication is a dispute resolution process created by contract in many modern standard form construction contracts. A common feature of adjudication clauses is that an adjudicator’s decision is binding on the parties, albeit not final, unless neither party gives a notice of dissatisfaction in relation to the decision within a stipulated time limit. Adjudication was born out of the necessity in a construction contract setting to have a means of resolving disputes speedily without the expeditious execution of the contract being unduly retarded.

Dear Members and Readers

The past month has been a busy time as many affected businesses in KZN strategised around an accelerated return to business activity. The Association pledged its CSI funding to the Hands of Hope campaign in its quest to support the rebuild KZN programme.

The adjudication of the Excellence in Construction and Health and Safety competitions were finalised over the past few months. It was pleasing to note that the sites judged were of a high standard and members will be honoured for their excellence at the Annual Awards, which will be hosted at Collisheen Estate in October. This will also mark the 120th year of celebration for the Association. Marketing opportunities are available to members for consideration.

We remind members of the Construction Alliance South Africa (CASA) webinar which will take place on 9 September at 14h00. CASA is an initiative which has united the construction industry under one umbrella body made up of some 36 professional, contractor, supplier, manufacturer and other allied industry bodies – essentially the construction value chain, with Master Builders KwaZulu-Natal as the Convener. The webinar will cover the role of construction in the economic recovery of South Africa with a line-up of outstanding speakers. Members who wish to participate can register for the webinar by clicking here.

The National Infrastructure Plan (NIP) 2050 has been prepared by Infrastructure South Africa and seeks to provide a plan for improved public infrastructure delivery to give effect to the objectives of the National Development Plan (NDP). Infrastructure development plays a significant role in the economy. The NIP has been released for comment and members are urged to provide input on the Plan.

A member promotion campaign is underway and includes several initiatives designed to showcase the members of the Association. These include an advertisement on the SAPOA website homepage, a radio campaign and a social media campaign.
 
In this month’s edition, a summary on the online panel discussion convened by the Association on the economic impact of the recent unrest in KZN is provided. The panel featured representatives from various business chambers across the province and from the Department of Trade and Industry.

Members are encouraged to read the article on the “Recognition of skills,” which will assess the level of a candidate on trades in the construction sector. A round-up of the findings and recommendations made by the report "The profile of Occupational Health and Safety (OHS) South Africa" is discussed in our health and safety feature. The profile of Occupational Health and Safety

On 30 July 2021, the Department of Employment and Labour launched the report titled: "The profile of Occupational Health and Safety (OHS) South Africa." The report is a project commissioned jointly by the International Labour Organization and the Department of Employment and Labour and provides a historical analysis of occupational health and safety in South Africa. The report contains several key themes and insights that came out of the confidential, semi-structured in-depth interviews with 34 purposefully selected participants.

Can an unsuccessful tenderer claim damages?

The Supreme Court of Appeal had to recently consider whether an unsuccessful tenderer could claim damages for loss of profits as a result of an Organ of State’s breach of its constitutional duties. The tender concerned the award of a contract to a joint venture in 2010 for the Nsami Water Treatment Works in Guyani.

During August 2021, National Treasury gave an overview of the 2021 draft Taxation Laws Amendment Bill proposed changes being considered for South Africa. Changes include amongst others addressing loopholes in the tax system and the taxation of retirement funds.

National Treasury's proposed “two-bucket” system for Retirement Funds

National Treasury issued a statement earlier this month noting that government and other stakeholders are exploring a ‘two-bucket’ system which would allow retirement and provident fund members early access to a portion of their savings in times of a financial emergency. The new proposed system makes provision for members to preserve savings until retirement for longer-term financial security, this means that members must preserve their contributions and the compounded growth invested and not have access to this portion until they retire.

Dear Members and Readers

Master Builders KwaZulu-Natal annual awards event held on 1 October 2021 recognised excellence in construction and health and safety, coupled with the celebration of the Association’s 120 year anniversary.

The picturesque Collisheen Estate in Umhlali proved to be the ideal open-air venue for hosting a glamorous event suitable for COVID-19 protocols. Matching the splendour of the event, popular South African comedian and actor Dr Riaad Moosa was the MC and entertainer.

In his welcoming address President of Master Builders KwaZulu-Natal, Mr Bhekisisa Samson Ngcongo applauded all entrants for their superior quality of work and commitment to health and safety, stating that their role in executing high calibre projects drives the sustainability of the construction industry.

The President further stated that considering the impact of the COVID-19 pandemic and the restrictions imposed, it had been a challenging time for the industry, further compounded by the recent unrest in KZN and Gauteng. It was reiterated that the Association remained steadfast in its commitment to keep the Association and industry afloat during these tough economic times.

Mr Ngcongo also took the opportunity to commend the Association for its role in convening Construction Alliance South Africa (CASA). “This marked a significant shift for the South African construction industry, with some 36 organisations working in collaboration on joint industry solutions.”

Vikashnee Harbhajan, Executive Director of Master Builders KwaZulu-Natal presented the recipients of awards and indicated that the Association celebrated entrants for demonstrating their unrelenting passion for Excellence in Construction and Health and Safety. Members received awards for the Health and Safety regional and national competitions and the Excellence in construction competition. Notwithstanding the challenging circumstances, a high standard of quality was maintained by member companies and members do not waiver on their commitment to Health and Safety during tough economic times.

Former Executive Director Pieter Rautenbach was presented with a Lifetime Achievement Award in recognition of his outstanding contribution and commitment to Master Builders KwaZulu-Natal for 32 years.

Special awards were presented recognising outstanding and positive contribution to the construction industry in KwaZulu-Natal. The Association congratulates the following recipients of special awards:

October, being international ergonomics month, is a time when we pause and consider how ergonomics can contribute to improving working conditions, preserve worker health and safety, while also boosting productivity and quality of work across all industries. During this time, I think it is prudent to consider if implementing ergonomics can contribute, alongside existing industry wide and organisation-specific efforts, to building a safer and more efficient construction industry in South Africa.

According to reports, given current low interest rates, there have been an uptick in property transactions. Therefore, it is worthwhile considering the potential impact of any transfer duty taxes to be imposed on such transactions. Following a turbulent week of unrest during the month of July 2021, several businesses across various sectors in the KZN province were affected. Whilst the full extent of the unrest is still being ascertained for the KZN construction industry, it has come to our attention that some construction sites were also impacted. The Association circulated information to members on force majeure, which highlighted the importance of raising the necessary notices for extension of time for delays as a result of the unrest in terms of the relevant contracts.

Sasria is a state-owned insurance company that provides insurance cover for incidents of unrest. President Cyril Ramaphosa in his speech on 25 July 2021 indicated that “Sasria has committed to expedite the payment of all valid claims.” It was further noted that support would be extended to uninsured businesses affected by the incident. Business and Government need to work together to build resilience and restore business confidence to attract investors to the industry. The Association is committed to engaging with relevant stakeholders to assist in the rebuild programme.

The Association continues to update members on COVID-19 protocols and information, as the move to Adjusted Alert Level 3 restrictions led to a greater opening of the economy. Members are reminded to take the relevant precautions and ensure workplace safety during this time. At this stage, member meetings will be hosted remotely and Association events will be considered in due course based on the Regulations in place.

We would like to remind members of the additional services offered through the Association’s Print Studio, Recruitment Agency, Training Academy, Occupational Health Clinics, Conference facility, Café Indaba and OHS Consulting units. Our services include administration of retirement funds as well as property leasing. The recent addition of a courier service at the Print Studio has added value to our one stop business hub. POPI Act - Appointment and Registration of Information Officer

The POPI Act designates the head of the business as the Information Officer. The Information Officer can delegate his or her responsibilities to any other duly authorised person and can appoint as many Deputy Information Officers as necessary. However, it is important to note that the Information Officer remains ultimately responsible for ensuring that the processing of personal information is done in a lawful manner and “retains the accountability and responsibility for any power or the functions authorised to that person”.
